You may submit content to Free the V Pty Ltd ACN 657 579 649 (“FTV”) through the website www.freethev.com (“Website”) in the form of a letter to your vagina, or by providing comments on your thoughts, feelings, insights or musings or any other comments after having written your letter (“Content”).
FTV encourages you to submit the Content via the Website for possible inclusion on the social media channels operated by FTV or its related entities, officers, employees, agents or representatives, including, but not limited to, Facebook, Instagram, TikTok, YouTube, on the Website and in any book, video, publication or marketing material created by or on behalf of FTV or its related entities, officers, employees, agents or representatives (“Publications”) any time after your submission.
You acknowledge that the letter writing is part of a campaign which provides an opportunity for women to inquire into, and explore, the conversations they have about their vaginas (“the Project”).
By submitting your Content through the Website, you acknowledge and agree that FTV:
may in its sole discretion determine whether or not to include the Content in any or all of the Publications; and
reserves the right to edit or amend any Content submitted by you prior to publication of the Content in any of the Publications.
By submitting your Content through the Website you:
warrant in favour of FTV and its related entities, officers, employees, agents or representatives that you have solely and personally authored the Content;
irrevocably consent to FTV editing, modifying or altering the Content in any way considered appropriate by FTV prior to publishing the Content in any of the Publications;
irrevocably consent to FTV or its related entities, officers, employees, agents or representatives publishing the Content in any of the Publications at any time and acknowledge and agree that you will not receive any monetary consideration for consenting to such publication;
irrevocably consent to FTV or its related entities, officers, employees, agents or representatives publishing the Content in any of the Publications without attributing you as the author of the Content or providing a copy of the publication to you for your review and / or approval prior to publishing it, or doing, or omitting to do, any other act which might otherwise, but for this consent, infringe on any of your moral rights;
immediately and irrevocably assign all of your intellectual property rights (including, but not limited to, copyright) in the Content to FTV upon submission of the Content through the Website; and
agree to indemnify FTV and its related entities, officers, employees, agents or representatives (“Indemnified Parties”) from any loss, cost, damage, claim, expense or other liability (including legal costs on a full indemnity basis) that any of the Indemnified Parties suffer or incur and which arises out of or is in relation to your breach of this agreement.
By submitting the Content to FTV, you agree that your involvement in the Project constitutes fair consideration for your submission, and that no monetary payment will be paid to you in exchange for your submission of the Content, now or in the future, and you irrevocably release FTV and its related entities, officers, employees, agents or representatives from any claim for the payment of monetary consideration in connection with the Content. If you do not agree to the provisions set out herein, then you should not submit your Content to the Website.
FTV agrees not to publish your name in connection with the Content in the Publications and will use reasonable endeavours to remove any personally identifying information from the Content which is clearly apparent to FTV prior to any publication of the Content in any of the Publications. You agree that you should not include any information in the Content which might expose your identity.
This agreement will be governed by the laws of ACT, Australia, and by submitting your Content, you agree to submit to the non-exclusive jurisdiction of the courts of ACT, Australia and any other courts which may hear appeals from those courts in respect of any proceedings in connection with this agreement.
If any term, provision or condition of this agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the rest of this agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
